The firm successfully defended a commercial landlord on appeal from a long-term commercial lease with a Subway franchise, arguing that a damage limiting clause which was part of the lease was unconscionable and formed without consideration. The reviewing court reversed a trial court decision concerning the clause and required the tenant to pay on the remainder of the lease obligation.
